Usage rights

Applies to every loop and pack downloaded from this site.

By downloading, you are granted a non-exclusive, non-transferable, perpetual right to use the loops in combination with other sounds in music productions to create new recordings which shall be considered "derivative works" as that term is used in the United States Copyright Act. This license permits you to modify, reproduce, publicly perform, distribute, transmit, sublicense, and otherwise use the loops as incorporated in your recording, including for commercial purposes, subject to the following restrictions:

1) Usage

  1. You may not use or sublicense the loops in isolation as sound effects, loops, or as source material for any other form of sample (even if you modify the sample).
  2. You may not redistribute loops in new sample packs.
  3. You may not sublicense, sell, loan, share, lend, broadcast, rent, lease, assign, distribute, or transfer any loop to a third part except as incorporated into a recording.
  4. You may not use the name, image, or likeness of the producers associated with the loops in any way without written permission by the producers.

2) Credit

You must always credit SMOKEY when using the loops. This includes any beats or recordings created with loops and beats sent out to all artists.

3) Online Sales

When selling a beat made with a loop from this pack, both the profit share and publishing royalties must be split 50/50 with Smokey.

4) Major and Minor Releases

For recordings to be distributed or released via a Major Label, Indie Label, or independently, you shall be required to:

  1. Contact smokey promptly to seek clearance for use of the loop on a major release;
  2. Provide for a 50/50 split of any Advances, Producer Royalty and Publishing, including for the avoidance of doubt, in relation to any so-called 'synch licenses'; and
  3. Provide smokey with Co-Producer credit on the liner notes of any singles or albums (in any configuration), in advertisements, and wherever metadata permits.
